These terms reflect how MyPopover actually operates today, but the language hasn’t been reviewed by counsel yet. We’ll publish the finalized version before any real transactions take place.
1. Who these terms cover
These Terms of Service (“Terms”) are between you and MyPopover (“we,” “us,” or “the Company”). They cover anyone who visits mypopover.com, joins the waitlist, signs up for an account, applies to be a companion, or uses the service in any other way. By doing any of those things, you agree to these Terms.
2. What MyPopover does
MyPopover is a two-sided platform that connects families (“Bookers”) with vetted independent contractors (“Companions”) who provide one-hour companion-care visits to older adults (“Recipients”). We facilitate the introduction, the booking, and the payment. We don’t employ Companions and we aren’t a healthcare provider.
3. Your account
- You must be 18 or older to create an account or apply to be a Companion.
- You’re responsible for keeping your password secure and for everything that happens under your account.
- One person, one account. Don’t share accounts across people.
- The information you provide must be true. If something changes (address, phone, etc.), update it.
4. Booker obligations
- You’re booking visits for an adult Recipient you’re authorized to act for. If you’re not the Recipient yourself, you confirm you have the Recipient’s consent (or appropriate authority) to share their details with a Companion.
- Be honest about the Recipient’s needs, mobility, and anything a Companion should know to make the visit safe and warm.
- You agree to pay the rate shown at the time you request a visit. Cancellation policy is in Section 7.
- Companions aren’t caregivers. Don’t ask them to administer medication, perform medical tasks, lift the Recipient, or do heavy housework. If the Recipient needs that level of care, MyPopover isn’t the right service.
- Visits are nonmedical companionship. Companions don’t handle money, pay or bank on the Recipient’s behalf, or access passwords, financial accounts, or medical or health portals. Errands are done together, side by side — Companions don’t run errands or drive the Recipient on their own.
5. Companion obligations
- You’re an independent contractor, not a MyPopover employee. You set your own availability, accept the visits that work for you, and decline the ones that don’t.
- You agree to pass a background check, sit for an interview with our team, and provide references. Approval is at our discretion.
- Show up on time, present, and ready for the activities the family chose. If you can’t make a confirmed visit, cancel as early as possible — late cancellations and no-shows have consequences (Section 8).
- Keep what you learn during visits confidential. Don’t share photos, names, or details of Recipients publicly.
- Don’t exchange personal contact information with Recipients or Bookers outside the platform. All coordination happens through our in-app chat.
6. Pricing
- Visits are one hour long. Pricing is shown at the time of booking ($70 single visit at launch).
- Bundle pricing (5-pack at $65/visit, 10-pack at $60/visit) is charged upfront. Credits never expire.
- Companions are paid weekly through Stripe Connect. Per-visit payout rates are shared at onboarding.
- We don’t charge booking fees, service fees, or subscription fees. The price you see is the price you pay.
7. Cancellation, no-shows, and refunds
- Booker cancels ≥48 hours before the visit: full credit refunded.
- Booker cancels <48 hours before: the visit is non-refundable.
- Companion cancels at any point: full credit refunded to Booker plus a free visit credit on us. Repeated late cancellations or no-shows trigger consequences for the Companion (Section 8).
- Companion no-show: same as Companion cancellation, plus the Companion is permanently removed from the platform.
- Companion doesn’t respond within 24 hours of a request: the request expires automatically. No charge to the Booker.
8. Conduct + consequences
We may suspend or remove accounts at our discretion for any of the following:
- Harassment, abuse, or discrimination of any kind.
- Dishonesty in profile information.
- Three late cancellations or no-shows in any rolling 12-month period (Companions).
- Sharing or soliciting contact information outside the platform.
- Asking Companions to perform medical or caregiver tasks outside the scope of companion-care visits.
- Any illegal activity.
9. Background checks
We run a criminal background check on every Companion applicant via Checkr. Approval requires consent to the check and a clear result. Companions may be removed if a subsequent check returns a disqualifying finding. Background checks don’t guarantee any outcome during a visit — Bookers retain responsibility for their own safety and for the Recipient’s safety.
10. Disclaimers
MyPopover isn’t a healthcare provider, a caregiving service, or a home-health agency. We don’t supervise visits. We facilitate introductions between Bookers and Companions and provide the platform for coordination and payment. The actual visit is between the Companion and the family.
The service is provided “as is.” We don’t warrant uninterrupted availability, error-free operation, or any particular outcome from a visit.
11. Limits of liability
To the maximum extent permitted by law, MyPopover’s total liability arising out of or related to these Terms or your use of the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100. We aren’t liable for indirect, incidental, special, consequential, or punitive damages.
Nothing here limits liability for fraud, gross negligence, willful misconduct, or anything else that can’t be limited by law.
12. Indemnification
You agree to indemnify and hold MyPopover harmless from any claim arising out of your breach of these Terms, your misuse of the service, or your conduct during a visit. We’ll do the same for any claim arising from our material breach of these Terms.
13. Termination
- You can close your account at any time by emailing hello@mypopover.com. We’ll process the request within a reasonable window; some records persist for tax/audit purposes per our privacy policy.
- We can suspend or terminate your account if we believe you’ve breached these Terms, at our discretion.
- Sections that should reasonably survive termination (disclaimers, limits of liability, indemnification, governing law, etc.) do.
14. Governing law + disputes
These Terms are governed by the laws of the State of [TBD — counsel will pick: likely Delaware for corporate matters, with venue-specific provisions where we operate]. Any dispute will be brought in the courts of [TBD], unless arbitration applies under a separately agreed arbitration clause.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to account holders by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
